DIVORCE PROCESS
Once the decision to get divorced is reached, the basic outline of the process followed is:
- Mediation
- Summons
- Service of Summons by Sheriff
- Summons is either opposed or unopposed - depending on the parties
- Opposed Summons - Plea is filed by the defendant
- Rule 43 Application for interim maintenance can be made
- Discovery of documents
- Divorce Action will proceed to trial
- Unopposed Summons - default judgment is obtained
- If there are minor children involved, a parenting plan will need to be entered into, and which must be endorsed by the Family Advocate before any Court will grant a decree of divorce.

Civil litigation is the process of resolving disputes between two or more parties, where the initiating party seeks either compensation or specific performance from another party or parties. These parties can be individuals or juristic persons, which are legal entities that share the same rights and obligations as a person, such as a company. Examples of civil litigation matters include disputes regarding money owed for various reasons (such as goods sold or services rendered), disputes for specific performances (for instance, when you have paid for a product or service that has not been delivered), property disputes, defamation, consumer protection, evictions, liquidations/sequestrations, and rehabilitations. CIVIL LITIGATION PROCESS
Depending on the type of claim, you can either follow an Action process (Summons) or an Application process (Notice of Motion). You will be guided on which process is the better route to take depending on the specifics of each case.
The Action process in its most basic form follows the following process:
1. Letter of Demand
2. Summons
3. Notice to defend
4. Plea (with or without counterclaim)
5. Plea to Counterclaim (if there is one)
6. Discovery
7. Pre-Trial
8. Trial
9. Judgment
10. Appeal (if there is a party unhappy with the outcome).
The Application process in its most basic form follows the following process:
1. Notice of Motion
2. Notice to Oppose
3. Answering Affidavit
4. Replying Affidavit
5. Hearing in Motion Court
6. Judgment
7. Appeal (if there is a party unhappy with the outcome).
